In support of our marketplace platform, we collect and use information about the merchants using our platform, partners that may be offering goods or services to our merchants, users of the third-party apps made available through our Website, and visitors to our Website. Information You Provide to RedCloud We receive and store any Personal Information you post to the Website or provide to us when you set up a user account, or sign up for our newsletters or promotions. You can choose not to provide such Personal Information, in which case you will not be able to access or use portions of the Website or some of their features.

  Ejercicio de estos derechos Puede presentar sus solicitudes por correo electrónico a privacy@redcloudtechnology.com. Podemos solicitarle información específica para confirmar su identidad y procesar su solicitud. La obligación de cumplir con una solicitud dependerá de diversos factores (por ejemplo, el motivo y la forma en que tratamos su Datos Personales). Si rechazamos total o parcialmente su solicitud, le informaremos los motivos de nuestra decisión en ese momento, salvo que una restricción legal lo impida.   Derecho a presentar una reclamación ante la Autoridad de Control Además de los derechos antes mencionados, si no está satisfecho con nuestra respuesta o con la forma en que tratamos sus Datos Personales, puede presentar una denuncia ante la autoridad de protección de datos de su lugar de residencia habitual. En Argentina, la denuncia puede realizarse ante la Agencia de Acceso a la Información Pública (AAIP), específicamente ante la Dirección Nacional de Protección de Datos Personales, autoridad de control que supervisa el cumplimiento de la Ley de Protección de los Datos Personales Nº 25.326. En caso de que tengamos conocimiento de que una entidad a la cual hemos proporcionado Datos Personales los está utilizando o divulgando de forma contraria a esta Política de Privacidad, adoptaremos las medidas razonables y apropiadas para prevenir, subsanar o detener dicho uso o divulgación.   Elaboración de perfiles (Profiling) Podemos analizar los Datos Personales que hayamos recolectado sobre usted para crear un perfil de sus intereses y preferencias, con el objetivo de contactarlo con información relevante para usted. Si esta elaboración de perfiles deriva en decisiones con efectos jurídicos o de similar relevancia, las mismas no se basarán exclusivamente en un tratamiento automatizado sin intervención humana, salvo que sea esencial para la ejecución del contrato celebrado con usted, esté autorizada por ley, o haya otorgado su consentimiento expreso. En caso de que las decisiones relacionadas con la elaboración de perfiles se basen únicamente en el tratamiento automatizado de datos y produzcan efectos jurídicos negativos o lo afecten significativamente de forma adversa, tiene derecho a solicitar una explicación sobre la lógica aplicada a dicha decisión. Podemos utilizar información adicional proveniente de fuentes externas para realizar este análisis de manera más eficaz. Asimismo, podemos utilizar sus Datos Personales para detectar y reducir riesgos de fraude y crédito.   Cumplimiento y resolución de controversias Si tiene preguntas o reclamos relacionados con esta Política o con el tratamiento de sus Datos Personales, puede comunicarse con privacy@redcloudtechnology.com.   1. Geral
    1. Esta Política de Privacidade descreve como a RedCloud e suas empresas afiliadas (“nós”, “nosso” ou “RedCloud”), bem como nossos prestadores de serviço não afiliados, tratam os dados pessoais que coletamos por meio do Marketplace. Devido ao caráter B2B (“de empresa para empresa”) do Marketplace (ver Termos e Condições do Uso do Marketplace, Cláusula 2) o processamento de dados pessoais é uma exceção. Por isso, esperamos processar poucos dados pessoais. Todos os termos não definidos no presente instrumento terão o significado que lhes é atribuído nos Termos e Condições de Uso do Marketplace (“Terms and Condições”), que são aceitos pelos Usuários do Marketplace (“Usuários”) com o uso do Marketplace. Os Termos e Condições podem ser atualizados de tempos em tempos à discricionariedade exclusiva da RedCloud.
    2. Para usar o Marketplace de maneira eficiente e segura, os Usuários devem, às vezes, fornecer certas informações/dados pessoais (“Dados Pessoais”), como por exemplo nome e sobrenome, endereço de e-mail, número de telefone, informações de cobrança e qualquer outra informação requerida para prestar os Serviços de Marketplace. Portanto, é necessário que a informação fornecida seja atualizada, verdadeira e precisa. A base para processarmos dados pessoais é a execução dos Termos e Condições de Uso do Marketplace pelos Usuários, o qual constitui um Contrato válido e vinculante. Podemos compartilhar Dados Pessoais com empresas afiliadas.
    3. A RedCloud Technologies Ltd, empresa registrada no Reino Unido sob o nº 08872820, com sede em 50 Liverpool Street, London, Uk, EC2M 7PY, é a empresa responsável pelo tratamento de eventuais Dados Pessoais coletados dos Usuários quando da utilização do Marketplace. O Encarregado pelo tratamento dos referidos Dados Pessoais pode ser contatado através do e-mail compliance@redcloudtechnology.com.
  2. Fornecimento de Dados Pessoais
    1. Os Usuários podem escolher voluntariamente, mas não são obrigados a, nos fornecer, apenas por razões comerciais, Dados Pessoais adicionais, como gênero, idioma(s) preferido(s), cidade ou outras informações, por exemplo quando os Usuários preenchem um formulário, respondem a pesquisas, participam de promoções, se comunicam com nossa equipe de suporte ou compartilham sua experiência conosco.
    2. Além disso, quando Usuários utilizam o Marketplace e os Serviços de Pagamento, coletamos informações pessoais automaticamente. Essas informações podem incluir: (i) Informação de geolocalização, como localização precisa ou aproximada determinada a partir do endereço de IP de dispositivo móvel ou de GPS. Também podemos coletar essa informação quando os Usuários não estiverem usando o aplicativo, se isso estiver habilitado por meio das configurações e permissões do dispositivo; (ii) Informações de uso, como as páginas e conteúdos, pesquisas por Produtos ou Serviços, mídias sociais e outras ações realizadas no Marketplace; (iii) Dados de registro e informações do dispositivo (incluindo cliques em links de aplicativos de terceiros), endereços de IP, datas e número de acessos, informações de hardware e software, identificadores únicos, dados de erros, dados de cookies, e as páginas visualizadas ou com as quais se interage antes ou depois de usar o Marketplace; (iv) Cookies e Tecnologias Similares, conforme descrito nesta Política de Privacidade; e (v) Informações de pagamento, como o instrumento de pagamento utilizado, dia e hora, valor do pagamento, data de validade do instrumento de pagamento, código postal e endereço para cobrança e outros detalhes relacionados ao pagamento, incluindo informações sobre interação com conteúdos e serviços disponíveis por meio da RedCloud.
    3. Desde que permitido pela legislação aplicável, podemos receber de provedores de serviços terceirizados ou parceiros informações adicionais sobre os Usuários, como referências, dados demográficos ou informações que ajudem a detectar fraudes e problemas de segurança, e combiná-las com informações que temos sobre os Usuários.
  3. Uso de Dados Pessoais
    1. Nós usamos Dados Pessoais para melhorar e desenvolver o Marketplace para: (i) permitir acesso ao Marketplace e à venda e compra de Produtos; (ii) realizar análises, depuração e pesquisa; (iii) comunicação, por exemplo, enviando mensagens, atualizações, alertas de segurança e notificações de conta; (iv) detectar e prevenir fraude; (v) configurar e personalizar a experiência com base em interações com o Marketplace, o histórico de busca e compra, preferências e informações de perfil, e outros conteúdos fornecidos.
    2. Nós usamos Dados Pessoais para: (i) criar e manter um ambiente de confiança e segurança; (ii) detectar e prevenir fraude, mensagens não desejadas, abusos, incidentes de segurança e outras atividades lesivas; (iii) realizar investigações de segurança e análises de risco; (iv) verificar ou autenticar informações fornecidas, realizar verificações em bases de dados e outras fontes de informação; (v) ajudar a resolver disputas; e (vi) cumprir a lei, responder a solicitações legais, prevenir danos, e proteger nossos direitos.
    3.   4. Cumprimento de lei
    1. Podemos divulgar informações a tribunais, autoridades policiais, autoridades governamentais ou públicas, autoridades fiscais ou terceiros autorizados, desde que sejamos exigidos ou autorizados por lei, ou quando a divulgação for razoavelmente necessária para: (i) cumprir com nossas obrigações legais; (ii) cumprir com uma exigência legal válida ou responder a demandas apresentadas contra a RedCloud; (iii) responder a uma exigência legal válida em relação a uma investigação criminal para tratar de atividades ilegais suspeitas, ou responder a qualquer outra atividade que possa expor a RedCloud ou qualquer de nossos outros Usuários à responsabilidade legal ou regulatória.     2.   5. Prestadores de Serviços
    1. Com relação a seus Dados Pessoais, os Usuários podem exercer seus direitos de (i) confirmar a existência de tratamento de seus Dados Pessoais; (ii) acesso a seus Dados; (iii) correção de Dados incompletos, inexatos ou desatualizados; (iv) eliminação de seus Dados, (v) solicitar, de maneira expressa, a portabilidade de seus Dados a outro fornecedor de produtos ou serviços; (vi) anonimização, bloqueio ou eliminação de dados desnecessários, excessivos ou tratados em desconformidade com a legislação aplicável; (vii) receber informação sobre eventuais entidades públicas e privadas com as quais seus Dados foram compartilhados, de acordo com as disposições previstas nas regulações aplicáveis sobre o tema.     2.     4. Os Usuários podem solicitar que Dados Pessoais sejam eliminados. Favor observar que se recebermos uma solicitação para eliminar Dados Pessoais, podemos conservar e usar os Dados Pessoais desde que necessário para cumprir nossas obrigações legais e regulatórias, inclusive aquelas relacionadas à prevenção e à identificação de fraude e lavagem de dinheiro.
  8. Segurança
    1. As informações pessoais que os Usuários inserem no Marketplace são completamente confidenciais e nós envidaremos os esforços comercialmente razoáveis para proteger sua privacidade. Quando dados e números correspondentes a cartões de créditos são inseridos, estes são criptografados de acordo com padrões de segurança para maior segurança dos Usuários.
    2. É importante que os Usuários se protejam contra acessos não autorizados a suas Contas, senhas e a seus computadores, dispositivos e aplicativos. Recomendamos utilizar uma senha exclusiva para cada Conta que não seja usada para outras Contas online. Certifique-se de fazer log off quando terminar de usar um computador compartilhado. Em caso de violação, o Usuário deve notificar à RedCloud imediatamente.
  9. Períodos de Conservação
    1. Dados Pessoais serão conservados apenas enquanto o Usuário permanecer cadastrado no Marketplace e, caso aplicável, pelo tempo exigido por disposições legais de conservação. Se uma Conta for encerrada, nós eliminaremos todos os Dados Pessoais que possuímos sobre essa Conta. Isso exclui dados para o cumprimento de nossas obrigações legais e contratuais.

Personal Information We Collect

In support of our marketplace platform, we collect and use information about the merchants using our platform, partners that may be offering goods or services to our merchants, users of the third-party apps made available through our Website, including Stripe and visitors to our Website.

  • Information You Provide to RedCloud

    We receive and store any Personal Information you post to the Website or provide to us when you set up a user account, or sign up for our newsletters or promotions. You can choose not to provide such Personal Information, in which case you will not be able to access or use portions of the Website or some of their features.
